The answer to this question depends on the severity of your disease. I'm afraid of going to trial. Will I have to go to trial if I don't want to?

If you do have to go to trial, and you are subject to cross examination in a deposition or in court, rules have been established to avoid embarassment and to make the process as uninvasive as possible. What about expenses? Will I be responsible for huge expenses even if I don't receive any money?

What if I do receive money. Won't expenses take away a big part of the money to which I am entitled?

If you receive settlement money prior to trial, expenses tend to run only between 3% to 5% of the moneys received. (Therefore, you will likely receive 95% to 97% of the money to which you are entitled.)

Is it possible that my case may "get lost" in group or class action settlement?

No. From time to time, asbestos producers and their lawyers approach us to discuss settling a group of cases. These settlements categorize cases by disease, and cases within each disease are subject of a range of settlement values. This strategy allows strong cases not to be affected by weak cases and vice versa. Furthermore, exceptional cases receive exceptional treatment, and those exceptional cases qualify for an even higher settlement. But, before any settlement becomes operative, that settlement must first be approved by you as the client.

What if I don't want to settle because I think that value is too low or that I want my day in court?

Then, you don't have to agree to the settlement. No client can be bound by a settlement without his/her consent. Each client has the right to accept or reject any settlement offer and have his/her day in court.
